§ 1 Scope
1.1 These terms govern the relationship between Study Core UG (haftungsbeschränkt) i. Gr., Pastor-Boelitz-Straße 9, 46483 Wesel, Germany ("Study Core" or "Provider") and its customers for all contracts covering online-tutoring services.
1.2 The terms apply to contracts concluded via the online portal https://study-it.education and by phone or e-mail.
1.3 "Customer" means Study Core's contracting party. "Participant" means the person actually attending the tutoring sessions. Customer and participant may be the same person.
§ 2 Subject of the contract and conclusion
2.1 Study Core exclusively offers individual 1:1 online tutoring, aimed in particular at university students and apprentices.
2.2 Study Core is the customer's contractual partner and owes the performance of the tutoring service. Lessons are delivered by qualified tutors engaged by Study Core on a freelance basis.
2.3 The contract is concluded by booking a session or package via Study Core's website and the subsequent payment confirmation.
2.4 Only the registered participant may use the booked sessions. Transfer to third parties is not permitted.
2.5 If the participant is a minor, the contract must be concluded by a parent or legal guardian, who becomes the contracting party and is responsible for compliance with these terms.
§ 3 Performance of lessons
3.1 One tutoring unit comprises 60 minutes.
3.2 Lessons take place exclusively online via the video-conferencing software provided by Study Core.
3.3 Sessions can be booked at any time, subject to availability shown on the website. Lessons also take place during school holidays and on public holidays, provided slots are offered.
3.4 Supplementary learning materials may be used during lessons. These may not be reproduced or passed on to third parties without Study Core's express consent.
3.5 Lessons are recorded (audio and video) for performance, documentation and quality-assurance purposes. Recordings are stored and processed in accordance with the privacy policy and serve in particular for learning logs, automated summaries and review.
§ 4 Prices and payment
4.1 The prices listed on Study Core's website at the time of booking apply. All prices are end prices.
4.2 Payment is due immediately on booking. Study Core accepts payments via Stripe and PayPal.
4.3 No registration or other ancillary fees apply.
4.4 In case of a failed payment or chargeback, the customer bears the resulting costs to the extent they are responsible for it.
§ 5 Tutoring packages
5.1 Tutoring packages may be purchased in addition to single sessions. Terms follow the respective offer on the website.
5.2 Purchased packages remain valid for 12 months from the purchase date. After this period, unused sessions expire without replacement.
5.3 Cash payouts or refunds for unused sessions from a package are excluded unless there is an important reason attributable to Study Core.
§ 6 Cancellation and rescheduling
6.1 The customer may cancel or reschedule a booked session free of charge up to 12 hours before the agreed start.
6.2 With a timely cancellation per § 6.1, the customer may choose between rescheduling or a full refund.
6.3 If cancellation happens less than 12 hours before the start, or the participant fails to show, the right to the session is forfeited. Refund or rescheduling is excluded.
6.4 Study Core may cancel sessions for important reasons (e.g. tutor illness, technical outages). In such cases, the customer is offered free rescheduling or a full refund.
6.5 A session is booked as a fixed 60-minute unit (§ 3.1). If the participant ends a session that has already started early, the agreed fee is due for the entire booked unit; there is no claim to a full or partial refund in this case. The statutory right of withdrawal (§ 14) and mandatory consumer-protection rights remain unaffected.
§ 7 Duration and termination
7.1 There are no minimum terms or notice periods. Each booking is an independent contract.
7.2 The right to extraordinary termination for an important cause remains unaffected.
§ 8 Technical requirements
8.1 The customer is responsible, at their own cost, for ensuring the technical prerequisites for online lessons.
8.2 Minimum requirements:
- Up-to-date browser (Chrome, Firefox, Edge, Safari or other Chromium-based browsers)
- Current operating system with regular security updates
- Working microphone and audio output (speakers or headphones)
- Camera (optional but recommended)
- Stable internet connection
8.3 If a session is lost due to technical problems on the customer's side, there is no right to refund, replacement lesson or damages.
8.4 Study Core may continue developing or replacing the software used. The customer will be informed in good time.
8.5 Complete protection against security risks on the internet cannot be guaranteed. The customer is responsible for securing their own system.
§ 9 AI-supported services and recordings
9.1 Study Core uses AI technologies to deliver the tutoring service. These include in particular:
- Audio and video recordings of sessions
- Automatic transcription (speech to text)
- AI-generated summaries and learning logs
- Progress analysis and personalised recommendations
- Automatic task correction and feedback
- Image analysis (e.g. of homework or worksheets)
- Translation features
- AI-supported chatbot
9.2 These features form an integral part of Study Core's service and cannot be individually disabled. By booking, the customer consents to their use.
9.3 Access to recordings, transcripts and AI-processed data is granted to: the customer (or legal guardian for minors), the assigned tutor and authorised Study Core staff.
9.4 Study Core does not guarantee the accuracy of AI-generated content. Automatic transcripts, summaries, corrections and recommendations serve as tools and do not replace the tutor's professional judgement.
9.5 Details of AI-related data processing, including providers and data transfers, are in the privacy policy.
§ 10 Liability
10.1 Study Core is liable for the proper performance of the agreed tutoring services.
10.2 In case of quality defects, Study Core is first entitled to provide remedy (e.g. by replacement lessons or changing the tutor).
10.3 Liability for damages is limited to intent and gross negligence, unless life, body or health are violated or material contractual duties are breached. For breaches of material contractual duties, liability is limited to the typical foreseeable damage.
10.4 Study Core does not guarantee any specific learning outcome. Lessons support individual development; achievement of specific academic or school results cannot be guaranteed.
§ 11 Data protection and transfer
11.1 Study Core processes personal data exclusively in accordance with applicable data-protection law (in particular the GDPR and the German Federal Data Protection Act).
11.2 By booking, the customer agrees that personal data will be transferred to service providers in the USA in order to deliver the AI-supported services. Study Core has concluded processing agreements and EU Standard Contractual Clauses with these providers to ensure an adequate level of data protection.
11.3 Full details of data processing, data-subject rights, processors and transfers to third countries are set out in the privacy policy.
§ 12 Retention periods
12.1 Audio recordings, video recordings, transcripts, summaries and other data processed or generated by AI services are stored for the duration of the contract and 24 months after contract termination.
12.2 The contract ends when a booked package expires without renewal or when the user account is deleted.
12.3 After the retention period, data is deleted automatically unless statutory retention obligations apply.
12.4 The customer may request earlier deletion at any time, subject to statutory retention obligations. Deletion takes place within 30 days of receipt of the request.
§ 13 Final provisions
13.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
13.2 There are no verbal side agreements. Changes and additions to these terms require text form.
13.3 If individual provisions of these terms are or become invalid, the validity of the remaining provisions remains unaffected.
13.4 Study Core is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
§ 14 Right of withdrawal
Consumers have a right of withdrawal under the statutory provisions for distance-selling contracts. Details are set out in the separate right-of-withdrawal notice.
